What we won’t do

We won’t:

take ownership of your work
sell your work to someone else
use your work out of context

Competition

If you enter:

your work can be featured
your work can be promoted

If you win monthly:

you’re automatically in the $100,000 yearly prize

Credit always stays with you

Your name stays on your work.
Your identity stays attached to what you create.

One rule

If it’s not yours — don’t post it.

Why this matters

BOOM TERMS OF SERVICE

1. YOUR RELATIONSHIP WITH US

Welcome to Boom (the “Platform”), provided by We Are Boom LLC (“Boom”, “we”, or “us”).

These Terms of Service (“Terms”) govern your access to and use of the Platform, including all related applications, websites, services, and content (collectively, the “Services”).

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, you must not use the Services.

If you are between 13 and 18 years old, you may only use the Services with the consent of a parent or legal guardian.

2. ACCEPTANCE OF TERMS

By accessing or using the Services, you confirm that:

you can form a legally binding agreement
you agree to comply with these Terms
you agree to Boom’s Privacy Policy and Community Guidelines

If you are using the Services on behalf of a business or entity, you represent that you have authority to bind that entity to these Terms.

3. CHANGES TO THE TERMS

We may update these Terms from time to time.

We will use reasonable efforts to notify users of material changes. Continued use of the Services after updates constitutes acceptance of the revised Terms.

4. YOUR ACCOUNT

To access certain features, you must create an account.

You agree to:

provide accurate and current information
maintain the security of your account
be responsible for all activity under your account

We reserve the right to suspend or terminate accounts that violate these Terms or harm the Platform.

5. USE OF THE SERVICES

Your access to and use of the Services is subject to these Terms and all applicable laws and regulations.

You may not:

use the Services if you are not legally permitted to do so
reverse engineer, modify, adapt, or exploit the Platform
use automation, bots, scripts, or scraping tools
impersonate others or misrepresent your identity
interfere with or disrupt the Services or servers
upload malicious code or harmful material
engage in spam, scams, or deceptive practices

All use must comply with Boom Community Guidelines.

We may remove content or restrict access at our discretion.

6. CREATIVE INTEGRITY & AI POLICY

Boom is a human-first creative platform.

The following is strictly prohibited:

AI-generated content of any kind
AI-assisted content where AI contributes to the creative output
synthetic or manipulated media presented as human-created

All content must be:

created by the user
original
the result of human effort and intent

Violations may result in:

content removal
disqualification from competitions
account suspension or permanent ban

7. USER CONTENT & RIGHTS

Ownership

You retain full ownership of the content you create and upload to Boom (“User Content”).

Boom does not take ownership of your work.

License to Boom

By uploading User Content, you grant Boom a:

worldwide
non-exclusive
royalty-free
transferable
sublicensable license

to:

host, store, and display your content
distribute and promote your content on the Platform
use your content in connection with marketing and promotion of Boom

This license exists only for the purpose of operating, improving, and promoting the Platform.

What This Means

Your work remains yours
You can use, sell, or license your work anywhere else
Boom will never sell your work to third parties without your permission

Competition Use

If you enter the Competition:

your content may be featured in connection with the Competition
your content may be promoted across Boom channels

If you are a Monthly Winner:

your content is automatically entered into the Annual Competition
you consent to its use in connection with that process

Name, Image & Likeness

You grant Boom the right to use your:

name
username
image
voice
likeness

solely for:

identifying you as the creator
promoting your work
promoting the Platform

Limits on Use

Boom will not:

claim ownership of your work
sell your content as standalone assets to third parties
use your content outside the Platform ecosystem without context

Your Responsibility

You confirm that:

you own your content or have all necessary rights
your content does not infringe on any third-party rights
your content complies with all Platform rules

8. CONTENT RESPONSIBILITY

You are solely responsible for the content you upload.

We may remove, restrict, or disable access to any content that:

violates these Terms
violates Community Guidelines
is harmful to users or the Platform

We are not responsible for User Content posted by others.

9. FEEDBACK

If you submit ideas, feedback, or suggestions:

Boom may use them without restriction
no compensation is owed
feedback is non-confidential

10. INDEMNITY

You agree to defend, indemnify, and hold harmless Boom and its affiliates from any claims, damages, or expenses arising from:

your use of the Services
your content
your violation of these Terms

11. DISCLAIMER OF WARRANTIES

The Services are provided “as is” and “as available”.

We do not guarantee:

uninterrupted or error-free operation
accuracy or reliability of content

To the fullest extent permitted by law, all warranties are disclaimed.

12. LIMITATION OF LIABILITY

To the fullest extent permitted by law, Boom is not liable for:

indirect or consequential damages
loss of profits, data, or goodwill

Total liability is limited to the amount paid by you to Boom in the past 12 months.

13. TERMINATION

We may suspend or terminate your account at any time if:

you violate these Terms
you harm the Platform or its users

You may delete your account at any time in the app.

14. GOVERNING LAW & DISPUTES

These Terms are governed by the laws of the State of Wyoming, USA.

Disputes must first go through an informal resolution process.

If unresolved, disputes will be handled exclusively in Wyoming courts.

Claims must be filed within one (1) year.

15. APP STORE TERMS

Apple

Apple is not a party to these Terms and has no responsibility for the Platform.

Google

Google is not responsible for compliance with these Terms.

16. GENERAL TERMS

These Terms constitute the entire agreement
If any provision is invalid, the remainder remains enforceable
Failure to enforce a provision is not a waiver
